Welcome to Mitho Bol. These Terms of Service ("Terms") govern your access to and use of our Bengali to Nepali language learning mobile application (the "Service"), operated by Mitho Bol ("we," "us," or "our").

1. Description of Service

Mitho Bol is a language learning mobile application designed specifically for Bengali speakers learning Nepali. Our "Bridge Learning" method leverages the linguistic similarities between Bengali and Nepali to accelerate the learning process.

Our Service includes:

• Structured 21-day language learning curriculum
• Vocabulary lessons with spaced repetition
• Interactive exercises and quizzes
• Progress tracking and achievements
• Cross-device synchronization (with account)
• Offline learning capabilities

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

2. Eligibility

To use our Service, you must:

• Be at least 13 years of age (or 16 in the European Economic Area)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

If you are under the age of majority in your jurisdiction, you must have your parent or guardian's consent to use our Service, and they must agree to these Terms on your behalf.

3. Account Registration

3.1 Creating an Account

Some features of our Service require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 One Account Per User

Each user may create only one account. Creating multiple accounts to abuse features, circumvent restrictions, or exploit the Service is prohibited.

4. Purchases and Payments

4.1 Free and Premium Features

Mitho Bol offers both free and premium features. Free users can access the first three days of lessons. Premium access unlocks the full 21-day curriculum and all features.

4.2 Payment Processing

All payments are processed through the Apple App Store or Google Play Store. We do not directly collect or store your payment information. Your purchase is subject to the payment terms and policies of the respective app store.

4.3 Refunds

Refund requests must be made through the app store from which you made your purchase:

• Apple App Store: Request a refund from Apple
• Google Play Store: Request a refund from Google

Refund eligibility and policies are determined by the respective app store. We encourage you to try the free lessons before purchasing.

4.4 Price Changes

We may change our prices at any time. Price changes will not affect purchases already completed.

5. License and Intellectual Property

5.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our app for your personal, non-commercial language learning purposes.

5.2 Restrictions

You may not:

• Copy, modify, or distribute the app or its content
• Reverse engineer, decompile, or disassemble the app
• Remove any copyright, trademark, or proprietary notices
• Use the app for any commercial purpose without our written consent
• Transfer your license to any third party
• Create derivative works based on the app or its content
• Use automated systems or bots to access the Service
• Extract, scrape, or collect content from the Service

5.3 Intellectual Property Rights

All content in our app, including but not limited to:

• Lessons, vocabulary lists, phrases, and exercises
• Audio recordings and pronunciations
• Illustrations, icons, and visual designs
• User interface and user experience designs
• Software code and algorithms
• Trademarks, logos, and brand elements

is owned by Mitho Bol or our licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

5.4 Feedback

If you provide feedback, suggestions, or ideas about our Service, you grant us a worldwide, royalty-free, perpetual license to use, modify, and incorporate such feedback without any obligation to you.

6. User Conduct

When using our Service, you agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Transmit any viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Use the Service in any manner that could damage our reputation
• Circumvent any access controls or usage limits
• Share your account credentials with others

7. User Content and Feedback

You may submit content through our feedback features. You are solely responsible for any content you submit and represent that:

• You own or have the right to submit the content
• The content does not violate any third-party rights
• The content is not illegal, harmful, or offensive

By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving our Service.

7.3 Content Removal

We reserve the right to remove any user content that violates these Terms or is otherwise objectionable, in our sole discretion.

8. Disclaimers

8.2 No Guarantee of Results

We do not guarantee that you will achieve any particular learning outcomes or language proficiency by using our Service. Learning results vary based on individual effort, prior knowledge, and other factors.

8.3 Educational Content Only

Our Service is intended for educational purposes only. The language content is designed for general learning and may not be suitable for professional translation, interpretation, or official purposes.

8.4 Accuracy of Content

While we strive to provide accurate and up-to-date language content, we do not warrant that all content is error-free. Languages evolve, and regional variations exist. Our content represents common usage but may not cover all dialects or contexts.

8.5 Service Availability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We are not responsible for any delays, delivery failures, or other damage resulting from limitations inherent in internet communications.

9. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mitho Bol and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the Service

11. Termination

11.1 Termination by You

You may stop using our Service at any time. To delete your account and associated data:

• Open the app and go to Settings
• Select "Delete Account"
• Confirm your deletion request

Account deletion is permanent and cannot be undone. Your learning progress and data will be deleted within 30 days.

11.2 Termination by Us

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your license to use the Service immediately ends
• You must cease all use of the Service
• We may delete your account and data

11.3 Survival

The following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

12. Changes to Terms

We may modify these Terms at any time. When we make material changes:

• We will update the "Last updated" date at the top
• We will notify you through the app or by email
• We will give you an opportunity to review the changes

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved as follows:

1. Informal Resolution: Before filing any formal proceeding, you agree to contact us at privacy@mithobol.com to attempt to resolve the dispute informally. We will try to resolve the dispute within 60 days.
2. Binding Arbitration: If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Delaware or remotely via video conference.
3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13.3 Exceptions

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

13.4 Time Limitation

Any claim arising from or relating to these Terms or the Service must be brought within one (1) year after the cause of action arises, or it is permanently barred.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mitho Bol regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.

14.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

14.6 Notices

We may provide notices to you through the app, by email to the address associated with your account, or by posting on our website. You may provide notices to us at the contact information below.

14.7 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, or internet outages.
